ROCK RAPIDS, Iowa | A Rock Valley, Iowa, man no longer faces a felony terrorism charge after it was dismissed earlier this week.
Michael Kats, 53, was arrested last week and accused of calling 911 and texting threats to harm his ex-wife to a Lyon County deputy. Law enforcement agencies subsequently spent three hours searching for him before arresting him.
District Judge Patrick Carr dismissed a charge of threat of terrorism Monday after Lyon County Attorney Shayne Mayer had moved to dismiss the charge because of insufficient evidence.
Kats has pleaded not guilty in Lyon County District Court to a misdemeanor charge of harassment of a public official. He has asked for a jury trial. A trial date has yet to be set.
